If, at any time, you do not agree to these Terms, please do not use this Site. Geek Street Productions LLC reserves the right to revise these Terms at any time by updating this posting. If we make material changes to the Agreement, we will notify you by email or through a message posted on the Services. You agree that such modified Agreement will be effective thirty (30) days after our notice to you, except for changes that relate to new features or for legal reasons, which will become effective immediately. Your continued use of the Services after our provision of notice to you will constitute your affirmative acceptance to the modified Agreement. If you do not agree to, or cannot comply with, the Agreement as amended, you must stop using the Services, and may cancel your subscription at any time by following the cancellation instructions under your “Subscription Contract.” As a condition of your use of this Site, you agree that you are at least 18 years of age and that you possess the authority to enter into a binding legal agreement. We grant you a personal, limited, non-transferable non-exclusive, license to access and use the Site via a browser. We reserve the right to revise the products and services available on the Site and to impose rules for and limits on use of the Site or to restrict your access to part, or all, of the Site without notice. We reserve the right to revoke your access at any time for any reason, including as a result of a violation of these Terms, without notice.

We may change the Service, Add-ons, or any features of the Service at any time, and we may discontinue the Service, Add-ons, or any features of the Service at any time, and we are not in any way liable to you for any modification, suspension, termination, or discontinuation.

You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to your whether or not such access to and use of the this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including without limitation financial obligations) incurred through such access or use.

You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Geek Street 101 of any unauthorized use of your password or identification or any other breach or threatened breach of this Site's security.

You may receive emails regarding your account or promotions for special offers, including third party offers.

Registration and Membership

Monthly boxes for Geek Street Productions LLC subscriptions and other subscription boxes offered from time to time are shipped to your address at the address you provided. You may receive emails regarding your account or promotions for special offers, including third party offers. You can cancel your membership anytime without charge by contacting Customer Support. Please refer to the Help Center for further details.

Billing and Payments

By starting your Geek Street 101 subscription and providing or designating a payment method, you authorize us to charge you on a recurring monthly subscription fee at the then current rate. We reserve the right to adjust pricing for our subscriptions in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Service, any price changes to your subscription will take effect following email notice to you.

For all purchases and Mail Call Subscriptions:

In-stock non- MMC subscription items are shipped within 1-3 business days. Address change requests should be sent immediately for purchases made with inaccurate address information but cannot be guaranteed as we do perform same day shipping on many of our items. Items that are Pre-Ordered must provided accurate address information or update the address through our email or submission form before the Pre-Ordered item is expected to ship. Social media address changes will not be honored due to fraud risk, instead, buyers must do so using their provided email address/customer information.

In an effort to get Mail Calls to our subscribers as soon as possible, we begin processing shipments prior to the actual shipping date. As a result, address changes need to be requested via the address change submission form or by emailing us directly at support@comictom101.com by the 15th of that month to ensure they are correctly reflected on your shipment. Our shipping service does not cover any cost associated with the forwarding of mail to an updated address. Any forwarding fees incurred will not be reimbursed or credited to your subscription or original charge. Packages that are returned or refused will be considered abandoned after they have returned to Geek Street Productions for 14 days. Failure to take action for redelivery and remit payment for redelivery of any package (Mystery Mail Call or any Comictom101.com Store purchase) will cancel the outstanding package minus a $15 restock fee. Shipping costs will not be refunded on items that have been shipped.

Returns

Damages and Return Policy

A picture must be taken with the damaged item next to the printed label and packaging it was shipped in to confirm receipt and that the damage is for your individual order.

You must initiate a damage request within 14 days of receipt or 30 days of shipment, whichever is sooner.

This is necessary to submit claims through insurance. Failure to do this can result in a lowered capacity for replacement and refunds.

Damage requests and notifications must be initiated within 14 days of receipt of the item or 30 days of shipment, whichever is sooner. If you fail to respond in a timely manner to any questions we have regarding this damage, you may forfeit the opportunity for replacement/refund as we are subject to insurance timelines with our carriers.

We issue replacements whenever possible, but will issue refunds on damaged sold out items. We may ask that an item is returned or destroyed with evidence before we remit replacements or refunds. Destruction is only in the case of print count protection.

International customers should note that we are especially held to longer insurance timelines to replace and refund their items. Accommodations will be made whenever possible for replacements but cannot be guaranteed. Reaching out as soon as possible can aid in this as the delivery window on international orders is much longer and shortens our window to help.

Keep the packaging long enough to take any pictures that show 1) the label 2) any external damage to the package and 3) the item next to the label in the same picture. At least one image must contain both of those things in the same image. More images should be provided if multiple items are damaged. Raw Books:

All raw books are pre-screened and circulated with the best conditions available, bagged and boarded. Printing outcomes can vary and we ensure presale buyers receive the best copies from any print run. Please note that we rely on industry standards for determining printing outcomes in regards to printing defects. Customers can expect to receive raw comics at 9.4+

Returns:

All items on our site are considered final sale and returns are not accepted. All discounted, preordered items, CGC books, and original art orders are included in this description. Damaged items may be returned for replacement or refund. Contact us at support@comictom101.com for any questions regarding damaged products and refer to the above damage policy.

For the Mystery Mail Call:

We accept one time per customer, a complete return requested within 30 days of your shipping date. The shipping in this case will be covered by the buyer.

While the randomness of the Mail Call brings you an opportunity to receive unique finds, we understand some of the challenges this brings. We ask you to hold us accountable. If any Mail Call doesn't live up to your expectations, we welcome the opportunity to make it right. Don't hesitate to reach out; your feedback is appreciated and we will work to remedy any situation within our power. We try to do our best to make things right with you before implementing a return process.

Because this is a mystery style subscription, it is a challenge to implement a hard and fast return policy other than what we offer, this is why we encourage you to reach out. Please note that some comics are from the secondary comic market, the condition of a collectible from the Silver, Bronze, and Copper through Modern age cannot be guaranteed and may have imperfections and varying grades and conditions.

Lost or Stolen Packages showing as delivered are at the loss and responsibility of the buyer. If a package is showing as delivered but is not at the customers location of delivery, they must make reasonable effort to locate the package including contacting the mail carrier and notifying them of the package loss so that the carrier can make an effort to locate the package in the event of a lost package. Missing packages are subject to the mail carrier's timeline to locate missing packages.

Geek Street Productions will not replace missing packages until evidence of this effort and the appropriate time to search for missing packages has passed. This potential replacement is at the discretion, courtesy, and availability of inventory of Geek Street Productions. We reserve the right to trust the tracking information of the carrier when it is showing delivered to the address provided to us by the buyer.

Import Fees/Duties

It is the sole responsibility of the buyer to coordinate import duties/fees/taxes for any package,

Any forwarding fees incurred will not be reimbursed or credited to your subscription or original charge.

Packages that are returned or refused will be considered abandoned after they have returned to us for 14 days. Failure to take action for redelivery and remit payment for redelivery of any package within 14 days will cancel the outstanding package minus a $15 restock fee. Shipping costs will not be refunded. It is up to the buyer to understand the import laws within their delivery country in regards to eligible goods and potential delays. Buyers using a delivery address outside of the US assume the risk that international mail can be severely delayed during global events and inclement weather and assume all responsibility, loss, and delay of items. Buyers must work with mail carriers and are subject to their timelines in the event of delay or missing mail.

YOUR SUBSCRIPTION CONTRACT

BY PURCHASING ANY SUBSCRIPTION, YOU ACKNOWLEDGE THAT YOUR SUBSCRIPTION HAS AN INITIAL AND RECURRING PAYMENT FEATURE AND YOU ACCEPT RESPONSIBILITY FOR ALL RECURRING CHARGES PRIOR TO CANCELLATION. YOUR SUBSCRIPTION WILL BE AUTOMATICALLY EXTENDED FOR SUCCESSIVE PERIODS, AT THE THEN-CURRENT SUBSCRIPTION RATE. All disputes and Mystery Mail Call complaints for active profiles must be submitted within 14 days of box shipment or before the shipment of your next month's box, whichever is sooner.

CANCELATION POLICY

To CANCEL a Mystery Maill Call Subscription you must contact us to request cancelation via this comictom101.com website submission or support@comictom101.com and not through any social media due to the increased risk of fraud. You must request cancelation 2 business days prior to your next charge to avoid new charges. You can also log in to your PayPal or subscription log in to effect your own cancelation prior to any future charges to avoid further charges. Cancelations take effect for upcoming charges only, any outstanding charges will be used to ship outstanding boxes. Subscribers may also request a profile cancelation directly through their PayPal profile or by contacting PayPal directly. Subscribers who receive the subscription price must be subscribed for a minimum of 2 months before cancelation will take effect. To cancel now, please fill out the Cancel Form by clicking HERE

In general, all sales from comictom101.com / comictom101.store are final. Preordered items where an order is made on your behalf cannot be cancelled or refunded including other items purchased with them. This includes CGC Preorders. Due to the nature of collectibles we are not able to accept cancelations or returns in most circumstances except in the case of damaged items. Preordered items are subject to delays by the publisher or in distribution. It is up to the customer to keep us informed with up to date mailing information in the event it changes before their item is to ship. Delays by the publisher or in distribution are common in the comic industry and do not qualify orders in general for cancelation or refund. In the case of damaged items we will submit a replacement whenever possible first. Please read our return and damage policy for more information if you receive a damaged item from us.

Product Information; Limitation on Quantities

Excluding any content which may be submitted by Members from time to time, we strive to ensure that the information on the Site is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies which we may correct without liability. We also reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted and/or acknowledged). We do not guarantee that all products described on our Site will be available. For the sake of clarity, we reserve the right to substitute any products within a specific crate with similar products of the same genre or delay the product delivery due to delay of shipment from the manufacturers or distributors to our warehouse.

You must provide us and keep us up to date with accurate contact and payment information, including name, shipping address, and credit or debit card number. We save your payment information for ease of future shipments and charges. All such personal information is subject to the Privacy Policy. You are responsible for any fees or charges your issuing bank or credit card provider may charge you. If your payment to us is returned for any reason, we may bill your account again directly and seek payment by another method including a mailed statement. Any account changes made after the 15th of each month should not be expected to reflect on the subscription until the following shipping period. Returns must be requested within 30 days of shipment and Pre-Ordered/Pre-Sale/CGC submissions that are submitted on your behalf are considered final sale and not returnable except in the case of damaged goods and are then subject to the insurance timelines and policies of the postal carrier (USPS, UPS, FedEx, or DHL)

Risk of Loss

Any merchandise purchased from our Site will be shipped by a third party carrier. As a result, title and risk of loss or damage for such merchandise will pass to you upon our delivery to the carrier. All missing or damaged shipments or items must be reported within 14 days of shipping to qualify for a replacement or refund based on product availability. If the product is available, a replacement will be shipped and a refund will not be issued or considered. Damaged items must be reported and include a photo in the ticket submission. Damaged items will be reviewed by the support agent and a replacement will be issued only for damaged products and does not cover or include packaging of said item. Blemishes to packaging will not be considered as part of a damaged item. All refunds will be at the discretion of customer support.

The technology underlying, and the entire content included in, the Site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of Geek Street 101 and is protected by copyright and other intellectual property or proprietary rights. We do not investigate to determine if such works are accurate nor can we provide assurance that all such works are free of typographical errors. We cannot guarantee information displayed on this Site to be 100% accurate.

By sharing, submitting and uploading any of your data (including but not limited to photographs, images, video, music, art, or comments) to Geek Street 101 website, Geek Street 101 social media channels (including, without limitation, Twitter (including # and @ comments incorporating Geek Street 101, ComicTom101, Mystery Mail Call or any other searchable term easily recognizable from the ComicTom101 social media channels), and Comic Tom 101 in discussion forums (e.g., Reddit), you grant Geek Street Productions LLC a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, prepare derivative works of, display and perform your user data in any legal manner for the benefit of Geek Street Productions LLC. You acknowledge and agree that you are solely responsible for all the user data that you make available through such means. Accordingly, you represent and warrant that: (1) you have all rights, licenses, consents and releases necessary to grant Geek Street Productions LLC the required rights to disseminate any user data, and (2) neither your data nor your posting, uploading, publication, submission or transmittal of this data or Geek Street Productions LLC use of your uploaded data (or any portion thereof) on, through or by the means of Geek Street Productions will infringe, misappropriate or violate a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights or rights of publicity or privacy or result in the violation of any applicable law or regulation.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Geek Street Productions LLC shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Geek Street Productions LLC shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Geek Street Productions LLC shall immediately issue a credit to your credit card account in the amount of the charge.

Geek Street Productions LLC has no liability for injury or damage caused by products within the crate. Such liability is the sole responsibility of the product brand or manufacturer.

These Terms are applicable to you upon your accessing the Site. These Terms, or any part of them, may be modified or terminated by Geek Street Productions LLC without notice at any time, for any reason. Geek Street Productions LLC reserves the right to limit discount codes to one per customer in its sole discretion. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous, shall in all events survive any termination of these Terms and your use of the Site.

Discount Codes

Except as may be explicitly permitted through this site, you agree not to sell, license, rent, lease,modify, distribute, copy, reproduce, publicly display, publish, transfer, edit, catalogue, aggregate, or create derivative works from discount codes received on or from this site.

Privacy

Registration data and certain other information about you are subject to our Privacy Policy.

Miscellaneous:

These Terms constitute the entire agreement between you and Geek Street 101 with regard to your use of the Site. Neither the course of conduct between the parties nor trade practice shall act to modify any of these Terms. Geek Street 101 may assign its rights and duties under this Agreement to any party at any time without notice to you.

Unclaimed Grails

We love putting grails into the Mystery Mail Call for the community to win. We know sometimes people miss that they won or find out later that they won. We will hold your grail for three months and if it is unclaimed, we will either reuse the book or sell it to upgrade for a better book for the Mystery Mail Call.

If you find out you won a grail after three months, we will do our best to work with you and get you something you will be excited about.

All proceeds of unclaimed books will be invested back into the Mystery Mail Call as an additional book for an upcoming month, invested for an upgraded grade, or the purchase of more grails that were not planned to put in future Mystery Mail Calls.
